Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, software, calculators, and AI services operated by MyShopMetrics LLC (“MyShopMetrics,” “we,” “us,” or “our”), including myshopmetrics.com and the 4man AI machining assistant (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
1. Who we are
MyShopMetrics LLC is a limited liability company. You can reach us at info@myshopmetrics.com.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract under applicable law to use the Services. When you create an account, you agree to provide accurate information and keep it up to date. You are responsible for all activity that occurs under your account and for keeping your credentials secure.
3. Subscription plans, billing, and cancellation
- Free plan: Available at no cost, subject to usage limits (currently 5 AI questions per day). Features and limits may change over time.
- Pro plan ($49/month): Includes a 14-day free trial. A valid payment method is required to start the trial. You will not be charged during the trial period.
- Automatic renewal: Unless you cancel before the trial ends, your Pro plan automatically converts to a paid subscription at $49 per month and renews every month thereafter. You authorize us (and our payment processor, Stripe) to charge your payment method for each billing period until you cancel.
- How to cancel: You may cancel your subscription at any time from your account (Manage Subscription) or by emailing info@myshopmetrics.com. Cancellation takes effect at the end of the current billing period; you retain Pro access until that date.
- No refunds for partial periods: Except where required by law, we do not provide refunds or credits for partial billing periods or unused portions of a subscription.
- Price changes: We may change subscription prices. We will give you at least 30 days’ notice before any price increase takes effect. If you do not agree to the new price, you may cancel before the change takes effect.
- Failed payments: If a payment fails, we may retry and may suspend or downgrade your account until payment is resolved.
4. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms;
- Reverse engineer, scrape, or attempt to extract model weights, training data, or non-public internals from the Services;
- Share your account credentials or resell access to the Services without our written permission;
- Submit content that infringes another party’s rights or violates applicable law;
- Overload, disrupt, or abuse the Services, including automated requests beyond stated rate limits;
- Use the Services to build a competing product or to train another AI system without our permission.
We may suspend or terminate accounts that violate these rules.
5. AI output, calculators, and professional judgment
Important — machining safety notice. The 4man AI assistant, calculators, and related outputs provide general information and suggested starting points for machining operations. They are not a substitute for a qualified machinist’s judgment, your tooling vendor’s published specifications, your machine’s capabilities, or applicable safety codes. Machining involves real physical hazards — tool breakage, workpiece ejection, fire, and personal injury are possible when operations are performed at incorrect parameters. You are solely responsible for verifying every speed, feed, parameter, process, and safety decision before running it on your equipment.
AI outputs may be incomplete, outdated, or incorrect. Always cross-reference against your tooling manufacturer’s data sheets, your machine’s operating manual, and your own setup conditions.
6. Your content and data
You retain ownership of the content you submit to the Services (shop profiles, conversations, calculator inputs, uploads — your “User Content”). You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display your User Content solely to operate, improve, and provide the Services to you. We may use aggregated or de-identified data to improve our Services. See our Privacy Policy for details.
7. Intellectual property
The Services, including the 4man name and brand, software, designs, calculator implementations, and AI system prompts, are owned by MyShopMetrics LLC or our licensors and are protected by intellectual-property law. These Terms do not grant you any rights in our trademarks or any other MyShopMetrics intellectual property except the right to use the Services as permitted here.
8. Third-party services
The Services rely on third parties, including Stripe (payments), Supabase (hosting and database), Anthropic and Voyage AI (AI models and embeddings), Render (application hosting), and Netlify (static site hosting). Your use of those third-party services is governed by their respective terms.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSHOPMETRICS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF OUTPUTS. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSHOPMETRICS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, TOOL BREAKAGE, WORKPIECE DAMAGE, OR PHYSICAL INJURY, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to defend, indemnify, and hold harmless MyShopMetrics LLC from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Services, your User Content, or your violation of these Terms.
12. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or for extended inactivity. Sections that by their nature should survive termination (including Sections 5–11) will survive.
13. Governing law and disputes
These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law rules. Any dispute arising out of these Terms will be resolved in the state or federal courts located in Iowa, and you consent to personal jurisdiction there.
14. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will notify you (for example, by email or by prominent notice in the Services) before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
